WARRANTY
Manufacturers Warranty:
Products sold by Zeagleexpress.com, a division of Aquatic Adventures., carry a manufacturer’s warranty. Warranty length varies by manufacturer. For information on a specific product, please call our customer service or contact the manufacturer.

Zeagleexpress.com is strictly a retail store. Reputable companies manufacture the products that we sell. Zeagleexpress.com does not inspect or test the individual items before shipping. Therefore, Zeagleexpress.com does not provide warranty service for any of the products sold on its web site. Warranties, if any, for those products that we sell are provided and serviced by the manufacturer of that particular product. Zeagleexpress.com does not warrant that any of the products sold perform as advertised by the manufacturers, their agents or by any other form of advertisement.

Before you purchase any product from our company, please check to make sure you completely understand the conditions of that manufacturer's warranty policy. Any and all warranty, repair or faulty equipment questions must be directed to the manufacturer of the item in question. Your after-purchase needs and concerns can easily be resolved by the manufacturer of that particular product. Neither Zeagleexpress.com or the manufacturer is responsible for the shipping costs of any item requiring warranty service.

Zeagleexpress.com does not provide warranty service for any of the products sold on this site. Any and all warranty, repair or faulty equipment questions should be directed to the manufacturer of the item in question. Zeagleexpress.com will not provide refunds or credits for any equipment that has been modified in any way.

Merchandise purchased for the purpose of resale is not covered under this warranty, nor is this warranty transferable. This limited warranty covers normal use. The limited warranty does not cover damage resulting from improper packing during shipment, damage during shipment, damage caused by failure due to usage not in accordance with product instructions, or failure to perform required preventive maintenance. Warranty coverage will not apply in the event the serial number has been removed, altered or defaced. During the warranty period, Zeagleexpress.com will, at its option, repair or replace defective or damaged products returned to our warehouse, or refund the amount you paid for the product less depreciation upon its return to our facility. Requests for warranty service can be made by calling our Customer Support Team. When calling this team, have the following information available: order number, serial number, a description of the problem and the type of equipment. Valid proof of the date of original consumer purchase, including the serial number of the product, may be required before warranty service is provided. If our technician determines that a warranted product is defective and that either a repair is necessary or that a replacement product is required, you will be given a Return Authorization ("R.A.") number for the return of the defective product. This number must be clearly marked on the outside of the original packaging, prior to return. You are financially responsible for the return of the defective product. The defective product must be received in our warehouse within fifteen (15) days in order to allow for one hundred (100) percent credit back to you. The defective product should be shipped to us prepaid and insured using the original box and packing materials (or equivalent packaging). Shipping and handling costs of the repaired or replaced product will be your responsibility. Zeagleexpress.com refurbishes its equipment from parts and components that are new or equivalent to new in accordance with industry-standard practices.

Zeagleexpress.com owns all parts removed from repaired products. Zeagleexpress.com uses new and reconditioned parts made by various manufacturers in performing warranty repairs and refurbishing products. If Zeagleexpress.com repairs or replaces a product, its warranty term is not extended. Under no circumstance will Zeagleexpress.com be responsible for any incidental or consequential damages, which may occur during the use of Zeagleexpress.com’s refurbished equipment, or as a result of the product's failure to perform. In all cases, the customer's sole remedy for a product failure is limited to the repair or replacement of the product.

ORDERING / SHIPPING
Refused orders will be subject to a $20 handling fee. Most orders are shipped within 48 hours. If any of the items you order are on backorder, we will notify you by email. See also RETURNS . C.O.D. cannot be used as a shipping method for Next day and 2nd Day shipments. All credit card transactions are verified according to the billing address listed on you credit card. If the billing address & zip code do not match, the credit card will be declined. This is for your safety and ours. We do not ship international orders nor accept international credit cards, due to shipping/exporting/importing/and verification issues.

Shipping:
Expected ground shipping times once your package leaves our shipping center (specific timeframe not guaranteed by UPS) are shown on MAP above. We are unable to ship via UPS Next Day or 2nd Day Air, any air tank shipments due to new federal regulations.

- Most orders placed before 12:00 PM EST. are shipped the same day
- Most other orders are shipped within 24-48 hours.

Freight/Back Orders : All freight and handling charges are calculated and added to the invoice total. Zeagleexpress.com will ship back orders automatically as products become available and the buyer will be liable for payment on any back orders unless Zeagleexpress.com receives buyer's cancellation prior to Zeagleexpress.com's shipment of same. We will not substitute or place your order on back-order status without notifying and receiving your permission to due so, on any item that will be out-of-stock for more than 5 business days. On any item that will be out-of-stock for more than 5 business days you will be offered a full refund or we can continue to process your order when the item arrives. You will receive and email/call in this event. In the event an item you order will arrive within 5 business days, we will continue to process and ship your order as soon as the item arrives. In this case, we will send you an expected ship/arrival date via email.

Customer Pick-Up Option:
Pick-up can be made Monday - at the field, please call 813-XXX-XXXX to verify pick up date. Ground shipping charges will still apply to certain items when using this option.

Holiday Shipping:
As we get closer to Dec. 25th, UPS, USPS, and FEDEX do not guarantee shipping times for any packages, including next day and 2nd day. During other major holidays some delivery delays may occur.

BUYER'S AGREEMENT
The buyer agrees to pay any and all collection and/or recovery costs, attorneys fees if the buyer's credit card company/payment method refuses (for whatever reason) to pay the charges to Zeagleexpress.com. The buyer agrees to provide sufficient, reliable, and accurate information to Zeagleexpress.com - name, address, e-mail address, and telephone number - for Zeagleexpress.com to be able to verify the legitimacy of the transaction; the buyer agrees to bring any legal action against Zeagleexpress.com only. The buyer represents that he or she is over the age of eighteen (18).

CLAIMS
Zeagleexpress.com inspects, and weighs, each order to insure its accuracy before shipping. Claims of shortages or damaged items must be reported (by filling in the CONTACT form and select RETURNS from the drop down menu) within 48 hours of delivery of the order. After 48 hours no claims will be honored. We do not honor oral claims, so please do not call us, as this will only delay our investigation. You, the customer, must retain the original shipping carton and packaging materials in the event that it becomes necessary to file a UPS missing item or damage claim. Title of merchandise passes to the buyer upon delivery by common carrier. Damaged or lost goods are the sole responsibility of the common carrier/transportation company. Buyer should immediately file claims for damaged or lost goods with the common carrier/transportation company.

RETURNS / RMA#
Zeagleexpress.com accepts returns on merchandise in accordance with the following:
All merchandise returns require Zeagleexpress.com's pre-approval and a return authorization number, an (RMA#) - obtained by filling in the CONTACT form and select RETURNS from the drop down menu.Zeagleexpress.com will refuse any returns received without an authorization number.

All returns must include a copy of the invoice and a letter of explanation. All merchandise returned for exchange must be within ten (10) days after the invoice date and must be in new, resalable condition, and contain all original packaging. A 25% re-stocking fee at invoiced prices is applied to all returned merchandise unless buyer makes a direct exchange. Items shipped by Zeagleexpress.com in error are not subject to restocking fees. Buyer forfeits all unused credit one (1) year after credit balance is established. If you have a damaged shipment, all products must be returned, processed and verified as damaged for proper UPS claim handling. Refunds or replacements cannot be given without submitting a claim with UPS. Any claim of missing items or damaged goods must be made by calling our customer service within 48 hours of receipt.

Conditions:
You may return most merchandise within 30 days of receipt of your order. Certain products may not be returned for any reason. These items include: XXXXXXX. Additionally, items that are missing parts or are damaged (broken, cracked, soiled, etc) can not be returned. Merchandise must be returned complete with all the original packaging, manual(s), blank warranty cards, miscellaneous parts and accessories. Incomplete returns will be subject to additional return charges as so determined by those items that are missing from the return.

All free items must be returned together with the purchased items in order to receive a refund. All products returned will be subject to a 25% restocking and/or reconditioning fee. No returns will be accepted after 30 days from the date you receive your order. You must obtain a Return Authorization (RMA) number from us before you can send any item back to our warehouse. If you attempt to send any package to our warehouse without the RMA number plainly visible on the outside of the package, that package will be returned to you. Shipping charges are not refundable; specially ordered or custom-made items are not refundable. No closeout items or specially discounted sales are refundable.

The customer must sign the front of their invoice where indicated and return the invoice along with the items or the return cannot be processed.

Process for Returns:
If you meet the conditions set forth above and wish to return an item(s) you must follow these directions:
1. First, fill in and submit the CONTACT form and select RETURNS from the drop down menu. Include your order number, the item you want to return and the reason for the return. Zeagleexpress.com will not take returns over the telephone; we require a Return Request Form for our audit trail. Not following this procedure will delay your return.
2. Zeagleexpress.com will email you with a Return Authorization (RMA) number usually within 48 hours.
3. Please write your authorization number on the outside of the box you are returning, next to your return address. Without a visible RA number on the outside of the return box, our receiving department will not accept the package and it will be returned to you.
4. The customer is responsible for shipping costs associated with merchandise being returned.

Refunds for Returns:
1. After receiving your authorized return Zeagleexpress.com will inspect the returned item(s) to ensure that the conditions set forth above are met.
2. If the item(s) you are authorized to return do not meet the conditions set forth above, Zeagleexpress.com will return the item(s) to you at your cost.
3. If all the conditions are met, Zeagleexpress.com will refund you the amount of the item(s) returned minus any applicable return fee. The refund will be issued by the same method you used for payment. Please allow a week from the time we receive your return for the refund to appear on your credit card.
4. Zeagleexpress.com will not refund you for merchandise that has been damaged in shipping due to incorrect packaging by the customer.

CANCELLATIONS
If, after placing an order with Zeagleexpress.com you decide that you do not want the order, you must cancel the order before we ship it by using our Cancel Order Form (do this by filling in the CONTACT form and select CANCEL ORDER from the drop down menu). If you cancel your order after Zeagleexpress.com has shipped it, you are still responsible for the costs associated with shipping it. Refusing to accept the delivery of your Zeagleexpress.com order does not constitute a cancellation of that order. You are still responsible for all costs associated with shipping the order to you. The refund that you will receive is only for the merchandise returned to us.

PAYMENT TERMS
Zeagleexpress.com accepts Visa, Master Card, Discover, Money Orders and Cashiers Checks. Credit Card orders are typically processed within 24 hours after they are placed. Money Orders and Cashiers checks will be processed when received.

If a buyer stops payment on merchandise already shipped, Zeagleexpress.com will place buyer on NO SHIP status and will charge buyer a $35.00 returned check/payment fee. Buyer agrees to pay all costs of collection, including reasonable attorney's fees, incurred by Zeagleexpress.com as a result of buyer's failure to make timely payment to Zeagleexpress.com.

TYPOGRAPHICAL ERRORS
We make every attempt to be sure that the information provided on Zeagleexpress.com's web site is accurate and correct, but occasionally an error can get by. We are not liable for any product informational typographical errors on the web site. If you find an error on the web site please report it to us for immediate correction.

In the event a Zeagleexpress.com product is listed at an incorrect price due to typographical error or error in pricing information, Zeagleexpress.com shall have the right to refuse or cancel any orders placed at the incorrect price. Zeagleexpress.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Zeagleexpress.com shall issue a credit to your credit card account in the amount of the incorrect price.

Zeagleexpress.com expressly disclaims any responsibility or liability for any damage, loss or injury arising out of your purchase or by the use of the goods sold by our store.

Caution
Scuba products are subject to conditions of extreme wear and corrosion. Inspection and maintenance are required to ensure continued performance. Zeagle Express recommends that you have your regulator inspected and serviced once a year on the anniversary date of its purchase at any authorized dealer worldwide. Scuba equipment should be used by certified Scuba divers only.

!! W A R N I N G !!

Scuba diving is an adventuresome activity that involves a degree of risk. Zeagle Express, Self Contained Underwater Breathing Apparatus (SCUBA) equipment is only to be used by those trained and certified by a nationally recognized scuba-training agency. Diving without the necessary training in safe diving procedures, or without observing the practices outlined by your training agency for your level of certification, is extremely hazardous and could result in serious personal injury or death. Owner’s manual that come with equipment sold through Zeagle Express, is in no way meant to be a substitute for the instruction received from a certified scuba-training agency.

All scuba equipment must be serviced only by dealers or technicians trained and authorized to service scuba equipment. At no time should any unauthorized person attempt to repair or adjust any nuts, bolts or screws other than those used specifically designed for customer adjustment. Scuba equipment that is not properly serviced might malfunction during use, putting the diver at risk of serious personal injury or death.

Zeagleexpress.com reserves the right to change prices and terms without notice. All prices and products are subject to availability. Buyers shall not use any Aquatic Adventures. or Zeagleexpress.com logos, trademarks, photographs, artwork, or copy in any advertising media without Aquatic Adventures. or Zeagleexpress.com's prior written consent. Buyer may only use logos, trademarks, photographs, artwork and copy provided Aquatic Adventures. or Zeagleexpress.com. Aquatic Adventures. or Zeagleexpress.com must approve in writing in advance the method, means, appearance, and medium for any use of our logos, trademarks, photographs, artwork, and copy.

Indemnity.
Dealer shall indemnify, defend, and hold harmless Aquatic Adventures. or Zeagleexpress.com from and against any and all claims, loss, and costs including reasonable attorneys' fees, (a) arising out of or in any way related to buyer's action as buyer hereunder and (b) any claims, demands, liabilities or expenses, including reasonable attorneys' fees, incurred by Aquatic Adventures. or Zeagleexpress.com arising out of or based upon the operation or use of the Products with any hardware, products, programs or data not supplied or approved in writing by Aquatic Adventures. or Zeagleexpress.com or the modification of the Products by buyer or anyone to whom buyer sells the Products.

Attorneys' Fees.
In the event of any legal action, arbitration or other proceeding brought by either party for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, then the prevailing party shall be entitled to recover reasonable attorneys' fees and other costs incurred, in addition to any other relief to which it may be entitled.

Arbitration.
If a dispute arises out of or relates to this Agreement, or the breach thereof, the parties agree to binding arbitration to resolve such disputes as follows: The party requesting arbitration shall do so by written notice to the other party/parties. The arbitration shall be held in the City of Tampa, County of Hillsborough, State of Florida, and conducted in accordance with the rules of the American Arbitration Association, before a panel of three arbitrators selected in accordance therewith. The parties will make all reasonable attempts to facilitate an efficient and effective arbitration process and will abide by and perform any award rendered by the arbitrator. The parties agree that the award may be entered as a judgment in any court having jurisdiction, or application may be made to such court for a judicial acceptance of the award and an order of enforcement. Nothing herein shall limit the right of any party to this Agreement to seek judicial equitable relief, or other equitable relief available to it under applicable statutory and/or case law including, but not limited to, injunctive relief.
